Terms and Conditions of Use

Agreement between the website user and Foty

Your access and use of the Platform constitutes your agreement to be subject to these Terms, which establish a contractual relationship between you and Foty.es. If you do not agree with these Terms, you may not access or use the Platform.

 

Rescheduling

If you need to reschedule your photo session, you should go to your dashboard under the "Bookings" tab, select the reservation, and click the "Reschedule" button. Our rescheduling policy are:

•       If the User reschedules in 3 days in advance of the photoshoot, we will issue a photoshoot credit of the same value which the User can use within the following 6 (six) months from the initial date of service booking.

•       If the User reschedules their photo session with less than 5 days of notice, a fee of 25% of the package price will be applied. Except for emergencies*.

*Emergencies such as natural disasters, illness, direct family member emergency, or last-minute travel restrictions.

 

Cancellation Policy

If the User needs to cancel the photo session, the User should inform us via email at info@foty.es with at least 3 (three) days of notice. Our cancellation policy works as follows:

•       If the User cancels their photo session with more than 3 (three) days of notice, they will be granted a photo session credit with the same value, which can be used within the following 6 (six) months from the initial date of service booking.

•       If the User cancels within 3 (three) days of the scheduled photo session, no credits or refunds will be issued.

•       In case of an emergency (natural disaster, illness, direct family member emergency, or last-minute travel restrictions), a photo session credit of equal value will be provided, which can be used within the following 6 (six) months from the initial date of service booking. The User should be aware that documentation may be required to support the claim.

d)   In the event that, due to adverse weather conditions, the contracted services cannot be carried out or their duration, execution, and/or quality are affected or interrupted, Foty and the photographer will make every effort to reschedule a new session based on the photographer's availability. However, if rescheduling the session is not possible, the Reservation Fee paid by the User will be validated and provided as credit towards a new service booking with a validity of 6 (six) months from the initial date of service booking.

e) The User must notify the photographer of their late arrival as soon as they are aware. The photographer will wait for 30 minutes without any prior contact. If the User does not show up for the photo session at the scheduled time and agreed-upon meeting place, no refund will be issued. The payment will go to the photographer for their time.

 

Fees

The User is responsible for any transportation fees or additional charges (museum entrance fees, park fees, Uber, bus and food.) required for you and the photographer.

 

Copyright Protection

The User will share a perpetual non-exclusive personal use license for the images. The image(s) cannot be used in any way that charges money, fees, or receives any form of compensation. The image(s) cannot be used in any type of advertisement. The image(s) cannot be resold, relicensed, or sublicensed. The photographer retains the copyright to all images taken.

 

Editing and Delivery of Photos

All our images will be edited and color-corrected. After the photoshoot, Foty will edit the chosen photos by the user or by the photographer. 

The User will be notified via email when their photos are available and will have a period of 30 days to download them.

 

Disclaimer of Liability

The User agrees to release Foty from any liability for damages, losses, and injuries to themselves or any person or property resulting from the use of our services, accepting full responsibility for any and all such damage or injury.

Foty will not be liable for incidents related directly or indirectly to our services.

 

Changes to the Terms

Foty reserves the right to make modifications and/or adjustments to these Terms at any time it deems convenient and/or necessary at its sole discretion, by publishing the new Conditions in the same manner and through the same channels as these.
